Plain-language summary (not part of the binding terms): uni4real is a marketplace that connects prospective students ("Applicants") with current university students ("Insiders") for paid 1:1 video calls. We are only the connector: we don't give you the advice, we don't guarantee any outcome (like admission or grades), and Insiders share their own personal opinions, not their university's. You use the platform at your own risk, payments run through Stripe, and we generally do not give refunds except in genuine exceptional cases. Please read the full terms below.
1. Who we are and what these Terms cover
1.1. These Terms of Service ("Terms") form a legally binding agreement between you ("you", "User") and Aytek Yenisen, an individual operating as a sole trader (empresario individual / autónomo) under the business name "uni4real", with business address at Calle de Toledo 123, 1A, 28005 Madrid, Spain ("uni4real", "we", "us", "our").
1.2. uni4real operates the uni4real platform, available via our website and applications (collectively, the "Platform").
1.3. By creating an account, accessing, or using the Platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Platform.
1.4. These Terms apply to all Users worldwide, whether you use the Platform as an Applicant, an Insider, or both.
2. Definitions
- Applicant: a User who uses the Platform to book and attend paid 1:1 sessions to obtain peer perspective and information from an Insider.
- Insider: a current student of a verified university who offers paid 1:1 sessions to Applicants through the Platform.
- Session: a scheduled 1:1 video call between an Applicant and an Insider conducted through the Platform.
- Credits: the prepaid in-Platform units an Applicant purchases and uses to book Sessions.
- Content: any text, images, profile information, messages, or other material that Users submit, post, or transmit through the Platform.
- Consumer: a User acting outside the scope of their business, trade, or profession, as defined under applicable consumer-protection law.
3. Eligibility and age requirements
3.1. Minimum age. You must be at least 16 years old to use the Platform. The Platform is not available to anyone below this age under any circumstances.
3.2. Users aged 18 and over. By using the Platform you represent that you have the legal capacity to enter into a binding contract.
3.3. Users under 18. If you are under 18 (but at least the minimum age in clause 3.1), you may only use the Platform with the verifiable consent of a parent or legal guardian. To provide this consent, your parent or legal guardian must:
(a) provide their full legal name and a valid email address; and
(b) review and sign, using their legal name, the parental consent waiver presented during onboarding.
We retain a record of this consent (including the parent/guardian's name, email, and the date and content of the consent given) for as long as the minor uses the Platform and as required by law.
3.4. Parental rights and oversight. A consenting parent or legal guardian may, at any time, request information about their minor's use of the Platform, withdraw their consent, and request closure of the minor's account, by contacting us at support@uni4real.com. Withdrawal of consent will result in suspension or closure of the minor's account.
3.5. Additional protections for minors. Where an Applicant is a minor:
(a) Sessions involving minors are subject to our monitoring rights (see Section 11) to a greater degree, and we may apply additional safeguards at our discretion;
(b) Insiders are strictly prohibited from soliciting, encouraging, or arranging any contact, communication, relationship, or payment with a minor outside the Platform;
(c) any conduct by any User that endangers, exploits, or is inappropriate toward a minor will result in immediate termination and may be reported to the relevant authorities.
3.6. We may, at any time, require age verification or proof of parental consent, and may suspend access pending such verification.
4. What uni4real is, and what it is not
4.1. We are an intermediary only. uni4real is a marketplace that introduces Applicants and Insiders and facilitates booking, payment, and video connection. We act solely as an intermediary / hosting service provider within the meaning of applicable law, including Regulation (EU) 2022/2065 (the Digital Services Act). We are not a party to the conversation or the advice exchanged during any Session. We do not provide, supervise, control, endorse, or verify the substance, accuracy, or quality of anything an Insider says, and we do not originate or adopt any User Content as our own.
4.2. No affiliation with universities. uni4real and the Platform are not affiliated with, endorsed by, sponsored by, or connected to any university, college, or educational institution. Insiders are independent individuals who happen to attend a given institution. Any reference to a university is for identification only. Insiders speak solely in their own personal capacity and share their own personal opinions and experiences, never on behalf of, or as a representative of, their institution.
4.3. Not professional advice. Information shared through the Platform is peer perspective and personal opinion only. It is not, and must not be relied on as, professional admissions consulting, educational, legal, financial, tax, medical, psychological, or any other form of professional advice. You should obtain independent professional advice before making any significant decision.
4.4. No guarantee of any outcome. We and our Insiders make no promise, representation, or guarantee of any kind regarding any outcome, including but not limited to admission, acceptance, rejection, scholarships, financial aid, grades, academic performance, enrolment, or any other result. Decisions you make based on a Session are your own responsibility.
4.5. Information may be inaccurate or out of date. University policies, programs, and experiences vary and change. An Insider's experience is personal and may not reflect your situation or current institutional practice.
5. Accounts and verification
5.1. Account registration. You must provide accurate, current, and complete information when creating an account and keep it updated. You are responsible for all activity under your account and for keeping your login credentials confidential.
5.2. Insider verification. We seek to verify that Insiders attend the university they claim by requiring verification via a valid institutional ("school") email address, and we conduct an internal review of Insider profiles, screening for evidence of fraud or misrepresentation. Verification is a reasonable-efforts process, not a guarantee. We do not warrant that any Insider's identity, enrolment, qualifications, or statements are accurate or genuine.
5.3. Fraud and misrepresentation.
(a) Insiders: Using another person's email, identity, or credentials to obtain verification, or misrepresenting your enrolment or affiliation, constitutes fraud. Any User who does so will have their account terminated immediately, will forfeit any pending payouts, and may be subject to legal action, including claims for damages, to the fullest extent permitted by law.
(b) Applicant remedy: If you are an Applicant and you paid for a Session with someone who, in breach of these Terms, bypassed our verification system and was not actually a current student of the university they claimed, or never attended that institution, you are eligible for a refund of the Credits used for the affected Session(s). Contact us at support@uni4real.com with supporting details.
5.4. We reserve the right to refuse, suspend, or revoke verification or any account at our sole discretion.
6. The Insider relationship (independent status)
6.1. Independent persons, not employees. Insiders are independent individuals. Insiders are not employees, agents, partners, contractors, or representatives of uni4real, and nothing on the Platform creates any such relationship. No Insider has authority to bind or make representations on behalf of uni4real.
6.2. Pricing is set by uni4real. uni4real sets the prices and Credit values for Sessions. Insiders do not set their own prices.
6.3. Taxes. Insiders are solely responsible for determining, reporting, and paying any taxes, social-security contributions, or other charges arising from amounts they receive through the Platform. uni4real does not provide tax advice and is not responsible for an Insider's tax compliance.
6.4. Payouts. Insider payouts are processed in accordance with our then-current payout policy and through our payment processor. We may withhold or reverse payouts in cases of suspected fraud, chargebacks, refunds, or breach of these Terms.
7. Pricing, Credits, payments, and refunds
7.1. Credits. Applicants purchase Credits, which are used to book Sessions. Credit prices, package sizes, and the Credit cost of Sessions are displayed on the Platform and may change from time to time. Credits have no cash value, are not a deposit, bear no interest, and (except as required by law or expressly stated) are non-transferable. Unused Credits expire twelve (12) months after the date of purchase and are forfeited thereafter, except where a longer period is required by applicable law.
7.2. Payment processing via Stripe. Payments are processed by our third-party payment processor, Stripe. By making a purchase you also agree to Stripe's applicable terms. We do not store full payment-card details. You represent that you are authorized to use the payment method you provide.
7.3. Consumers: express consent to immediate performance and waiver of withdrawal right. If you are a Consumer in the EU/EEA (or another jurisdiction with equivalent rights), you normally have a statutory right to withdraw from a distance contract within 14 days. By booking and attending a Session, you expressly request that we begin performance immediately and you acknowledge that, once a Session has been fully performed, you lose your right of withdrawal in respect of that Session. For Credits purchased but not yet used, your statutory withdrawal right may continue to apply until the Credits are used or the withdrawal period expires, whichever is earlier.
7.4. No refunds except in exceptional circumstances. Other than (i) the withdrawal rights described in clause 7.3 to the extent they apply, (ii) the fraud-related remedy in clause 5.3(b), and (iii) any non-excludable rights you have under applicable law, all purchases and Sessions are final and non-refundable. In genuinely exceptional circumstances, you may contact our team at support@uni4real.com, and we will review your situation and resolve it as we consider fit, at our reasonable discretion. This does not limit any mandatory statutory consumer rights you may have.
7.5. Chargebacks. Initiating a chargeback or payment dispute without first contacting us and allowing us a reasonable opportunity to resolve the issue is a breach of these Terms. We reserve the right to suspend accounts, dispute illegitimate chargebacks, and recover associated costs.
7.6. Price changes. We may change Credit prices and Session costs prospectively. Changes do not affect Credits already purchased.
8. User conduct and Content rules
8.1. You agree that you will not, and will not allow anyone to:
(a) harass, threaten, bully, defame, discriminate against, or abuse any other User or any staff member;
(b) share, request, or facilitate the sharing of confidential, proprietary, or stolen materials, including genuine exam papers, test questions, answer keys, application materials belonging to others, or any other person's work;
(c) impersonate any person or entity, or misrepresent your identity, affiliation, enrolment, or qualifications;
(d) use the Platform to engage in or facilitate fraud, academic dishonesty, cheating, or any unlawful activity;
(e) circumvent the Platform, for example by arranging, soliciting, or completing Sessions or payments off-Platform to avoid fees, or by exchanging personal contact or payment details to take the relationship off-Platform;
(f) post or transmit Content that is illegal, harmful, sexually explicit, hateful, violent, or otherwise inappropriate, or that infringes any third party's rights;
(g) collect, store, or misuse other Users' personal data;
(h) interfere with, disrupt, scrape, reverse-engineer, or attempt to gain unauthorized access to the Platform or its systems;
(i) use the Platform in any way that exploits, endangers, or is inappropriate toward a minor.
8.2. Your responsibility for your Content and conduct. You are solely responsible for your own Content and conduct on the Platform. You represent that you have all rights necessary to share any Content you submit.
8.3. Reporting. If you encounter conduct that violates these Terms, or that raises a safety concern (especially regarding a minor), please report it immediately to support@uni4real.com.
9. Disputes between Users
9.1. Sessions, advice, and interactions take place between Users. Any dispute, disagreement, or claim regarding the substance, quality, accuracy, or usefulness of advice, or otherwise arising between an Applicant and an Insider, is a matter between those Users.
9.2. We do not adjudicate the quality or accuracy of advice and are not responsible for resolving such disputes. We may, but are not obliged to, provide limited assistance (such as the exceptional-circumstances review under clause 7.4 or action against verified fraud under clause 5.3).
9.3. To the maximum extent permitted by applicable law, you release uni4real (and its owner) from any and all claims, demands, and damages arising out of or connected with any dispute between you and another User.
10. Intellectual property
10.1. Our IP. The Platform, including its software, design, branding, trademarks, and all related materials, is owned by or licensed to uni4real and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for its intended purpose, subject to these Terms.
10.2. Your Content. You retain ownership of Content you submit. You grant uni4real a worldwide, non-exclusive, royalty-free license to host, store, display, and use your Content as necessary to operate and provide the Platform.
10.3. You must not copy, modify, distribute, sell, or create derivative works from the Platform except as expressly permitted.
11. Recording, monitoring, and privacy
11.1. Monitoring rights. We reserve the right to monitor Sessions and other activity on the Platform for safety, quality, legal-compliance, and trust-and-safety purposes. This does not mean that every Session is recorded. We will indicate where a Session is being recorded where required by applicable law, and recording (where it occurs) is subject to our Privacy Policy.
11.2. Consent to monitoring. By using the Platform, you consent to such monitoring and, where applicable and disclosed, recording. Sessions involving minors may be subject to enhanced monitoring (see clause 3.5).
11.3. Data protection. We process personal data in accordance with our Privacy Policy and applicable data-protection law, including the EU General Data Protection Regulation (GDPR) and Spanish data-protection law (Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales, "LOPDGDD"). Our Privacy Policy explains what we collect, why, where it is stored, how long we keep it, and your rights (including access, rectification, erasure, and the right to lodge a complaint with the Spanish Data Protection Authority, the Agencia Española de Protección de Datos, "AEPD", www.aepd.es).
12. Disclaimers
12.1. "As is." To the maximum extent permitted by applicable law, the Platform and all Sessions, Content, and information are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
12.2. We do not warrant that the Platform will be uninterrupted, error-free, secure, or that any defects will be corrected.
12.3. Use at your own risk. You acknowledge that you use the Platform, attend Sessions, and act on any information at your own risk, and that the value, accuracy, and reliability of peer perspective vary and are not guaranteed.
12.4. Nothing in this Section excludes or limits any warranty or right that cannot be excluded or limited under applicable mandatory consumer-protection law.
13. Limitation of liability
13.1. Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) gross negligence or intentional misconduct; or (d) any other liability that cannot lawfully be limited or excluded.
13.2. Subject to clause 13.1, and to the maximum extent permitted by applicable law:
(a) we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, opportunities, data, goodwill, or anticipated savings, arising out of or in connection with the Platform or any Session;
(b) we will not be liable for the conduct, statements, advice, accuracy, acts, or omissions of any User, including any Insider or Applicant, or for any decision you make or outcome you experience based on a Session;
(c) our total aggregate liability to you arising out of or in connection with these Terms or the Platform will not exceed the greater of (i) the total amount you paid to us in the six (6) months immediately preceding the event giving rise to the claim, or (ii) EUR 100.
13.3. These limitations apply regardless of the legal theory on which a claim is based and even if we were advised of the possibility of such damages.
14. Indemnification
14.1. To the extent permitted by law, you agree to indemnify, defend, and hold harmless uni4real and its owner, directors, officers, and personnel from and against any claims, liabilities, damages, losses, and reasonable costs (including legal fees) arising out of or related to: (a) your use of the Platform; (b) your Content or conduct; (c) your breach of these Terms; (d) your violation of any law or any third party's rights; or (e) any dispute between you and another User.
15. Suspension and termination
15.1. By you. You may stop using the Platform and close your account at any time.
15.2. By us. We may suspend, restrict, or terminate your access to all or part of the Platform, with or without notice, at our discretion, including if we reasonably believe you have breached these Terms, engaged in fraud, posed a risk to other Users (especially minors), or where required by law.
15.3. Effect of termination. On termination, your right to use the Platform ends. Provisions that by their nature should survive (including Sections 4, 7.4 to 7.5, 9, 12, 13, 14, and 18) survive termination. Termination does not entitle you to a refund except as provided in these Terms or required by law.
16. Changes to these Terms
16.1. We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or an in-Platform notice) before they take effect. Your continued use of the Platform after changes take effect constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Platform.
17. Governing law and dispute resolution
17.1. Governing law. These Terms and any dispute arising out of or in connection with them are governed by the laws of Spain, without regard to conflict-of-law rules. If you are a Consumer, you also benefit from any mandatory protections of the law of your country of habitual residence that cannot be derogated from by agreement.
17.2. Courts. Subject to clause 17.3, the courts of the city of Madrid, Spain have jurisdiction. If you are a Consumer, you may also bring proceedings in the courts of your country of residence, and we will bring any claim against you only in the courts of your country of residence, as required by applicable law.
17.3. Out-of-court dispute resolution for Consumers. The European Commission's Online Dispute Resolution (ODR) platform was permanently discontinued on 20 July 2025 (pursuant to Regulation (EU) 2024/3228) and is no longer available. If you are a Consumer and we are unable to resolve a complaint directly, you may be entitled to refer the dispute to an alternative dispute-resolution (ADR) body. In Spain, consumers may turn to the public consumer-arbitration system (Sistema Arbitral de Consumo) and to the municipal and regional consumer information offices (Oficinas Municipales de Información al Consumidor, "OMIC", and the consumer authorities of the relevant Comunidad Autónoma). We are not obliged to participate in proceedings before a consumer dispute-resolution body, but will inform you if we agree to do so. A directory of certified EU dispute-resolution bodies is maintained by the European Commission at https://consumer-redress.ec.europa.eu/dispute-resolution-bodies.
18. General
18.1. Severability. If any provision is found invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be replaced by a valid one that most closely reflects its intent.
18.2. No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
18.3. Assignment. You may not assign your rights or obligations without our consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or a change in the legal form under which the business operates (including incorporation as a company).
18.4. Entire agreement. These Terms, together with the Privacy Policy and any policies referenced, constitute the entire agreement between you and us regarding the Platform.
18.5. Language. These Terms may be provided in multiple languages; in the event of conflict, the English version prevails, except where mandatory consumer law (including in Spain) requires otherwise.
